EUROGAMES HELSINKI 2016
– TERMS & CONDITIONS –

You will be deemed to have agreed to these Terms and Conditions by your act of registering to participate in any role or event in the EuroGames Helsinki 2016.

EuroGames Helsinki 2016 is organised by H.O.T. ry, a non-profit association registered in Helsinki, Finland referred to hereafter as “EGH”.

EuroGames® is licensed by the European Gay & Lesbian Sport Federation (EGLSF).

Disclosure of personal information

I understand that as part of the registration process of EuroGames Helsinki 2016, personal information is being collected by EGH and stored in accordance to Finnish legislation (see Description of Data). I consent to the collection, use and disclosure of my personal information for the purpose of enabling my participation in the sports, conference and cultural program of EuroGames Helsinki 2016; and for the purpose of receiving information related to my participation in this event from EGH in the form of electronic newsletters, promotional flyers and other communication media.

I give my consent to EGH to disclose my personal information to third parties involved, on behalf of EGH, in the organisation of EuroGames Helsinki 2016 and to the European Gay & Lesbian Sport Federation for the purposes of promoting EuroGames Helsinki 2016 and for promoting future events of EGLSF’s member associations.

Age Policy

Age limit to EuroGames Helsinki 2016 is 16. Under 18 year olds are allowed to participate only with parental consent. The participant should be 16 years old or above on 29th of June 2016.

Gender Policy

During EuroGames Helsinki 2016 participants may choose to participate as female, male or other after self or non-identification.

EuroGames Helsinki provides following guidelines regarding participation in gender-based classes (female and male):

A male-to-female/x that is or has been in the process of transitioning may compete in the category “female” if she/they has been undergoing uninterrupted hormone treatment for at least one year prior to the beginning of the competition. (If wanted she/they may at any time compete in the category “male”.) A female-to-male/x that is or has been in the process of transitioning may at any time compete in the category “male”. An individual who is on testosterone therapy do not need to pre-apply for exemption for therapeutic use, ie before arrival at EuroGames Helsinki. If excessively high testosterone values show up in a doping control, he/they will then be given the opportunity to submit medical evidence for therapeutic use. (Individuals who have begun hormone treatments with testosterone may never compete in the category “female”.)

Please note that the above is only guidelines and that EuroGames Helsinki welcome people after the regulation; “non- or self identification” make an individual choice.

Exceptions:

The rules mentioned above do not apply to following sport events: swimming. These sport events are played under other governing bodies with sanctioning requirements (regarding participation in gender-based classes) stricter than EuroGames Helsinki’s 2016. EuroGames Helsinki 2016 aims to improve such sanctions. Due to such regulations EuroGames Helsinki may be forced to transfer a participant to an other gender-based category.

Athletes seeking to be exempted from the provisions of this policy may request that their circumstances be reviewed. A panel consisting of the Directors of the EuroGames Helsinki 2016 will carry out such a review.

Health and insurance

I declare that I am in a physically fit and healthy state required for participation in events of EuroGames Helsinki 2016 for which I am registering, and that I am not aware of any serious medical condition that would prevent me participating in these physical activities. For clarification, it is agreed that having been diagnosed as HIV positive is not considered a “serious medical condition” for the purposes of this clause.

If I sustain an injury or illness while participating in any role in the EuroGames Helsinki 2016 EuroGames Helsinki 2016, I hereby authorise any medical or health personnel to perform and administer first aid medical treatment as deemed necessary and to seek more specialised medical attention at hospitals and health care institutions if deemed necessary by any first aid and medical staff or contractors of EGH.

I accept that it is my responsibility to organise my own travel insurance and personal accident insurance to cover my property and myself for the whole period of the EuroGames Helsinki 2016. I agree that I have hereby been advised to acquire adequate personal accident and health care insurance as a participant in any role, registrant of EuroGames Helsinki 2016.

I acknowledge that I am fully aware of the risks and hazards inherent in participation in the different events of EuroGames Helsinki 2016. I acknowledge and agree that I have elected to voluntarily enter this agreement and to assume all risks of loss, damage and injury, including death that I may sustain as a consequence of my participation in any of the sports or other events that I have registered for. I hereby fully release EGH and all of its affiliated companies, sponsors, servants, agents, officers, directors, members and employees from any claims, actions, suits or demands of whatsoever nature arising out of or related in any way to my participation in the Event including any loss, damage, injury or death sustained by a third party as a result, directly or indirectly, of my participation in the event. I hereby fully indemnify EGH and all of its affiliated companies, sponsors, servants, agents, officers, directors, members and employees against all expenses, losses, damages and costs that they may incur as a result of my participation in the event.

Rules and regulations

I agree to abide by the rules and regulations of the EuroGames Helsinki 2016 events as determined by EGH and governing bodies for sport and cultural events including all written and verbal instructions given by EGH designated officials and event managers. I accept that decisions of EGH and EuroGames Helsinki 2016 judges and tournament officials are final.

EGH reserves the right to have officially-designated officials reclassify sports, cultural and conference participants where the registrant has self-selected a grade, level, category, division or other classification. EGH reserves the right to combine or eliminate grades, levels, rounds, event lengths, categories, divisions, or other classifications if it deems necessary at its complete and sole discretion.

I agree that failure to comply with the official instructions, rules and regulations of EGH or governing bodies for sports, conference and culture events may result in immediate disqualification for events or from the games.

I am aware of that some venues or locations may have restricted accessibility or restrictions to serve special needs. Helsinki and Finland are committed to make sport, politics and culture accessible for everybody. Finland has legislation that prohibits any kind of discrimination due to special needs or disabilities. All public places must be accessible to persons with special needs and/or disabilities. EuroGames Helsinki 2016 will follow local legislations and aim for a fully accessible event independent of any special needs or disabilities.

Refund policy

Venues, competition days and schedules of events may be changed or cancelled at EGH absolute discretion after EGH may decide to provide a refund of participation fees. In the event that EGH cancel the whole event or parts of the event for any reason whatsoever, I agree that I shall have no claim or action against the EGH in respect of any loss, damage or expenses incurred by me as a result of such cancellation and accept and agree that I will only be entitled to a refund of the registration fee. In the event where I as a participant can no longer take part in the upcoming event I accept and agree that no claim or action will be taken against EGH regarding pay back of the registration fee. In the event of cancellation due to force majeure, I agree that I will not be entitled to any refund or compensation.

Outreach

I accept that some participants of EuroGames Helsinki 2016 may have their registration fee deducted or removed or gain other economical benefits as part of EuroGames Helsinki 2016 Outreach programme. The criteria for gaining such benefits are based upon EGH Outreach Policy, which can be received from EGH and will be provided to all who apply for the outreach programme.

EuroGames Helsinki 2016 Outreach Policy:

The aim for the EGH outreach programme is to enhance the diversity of participants in the Helsinki championship. Therefore EGH have chosen areas importance that could be beneficial to outreach applicants. The areas are chosen after previous underrepresentation for EuroGames. The selection process will focus on; geographical area, gender, age and financial situation. Those applicants who haven’t participated in EuroGames before and have not received outreach support before will as well be favoured.

Trademarks and branding

I agree not to make any unauthorised use of the EGH logo or trade marks including “EuroGames”, “EuroGames Helsinki 2016”, “EGLSF” or any variation on these, on personal or team uniforms/clothing, merchandise, or promotional material and to abide by EGH’s policies governing use of logos and trade names.

I agree not to act in a way that would compete with or devalue the EGH and European Gay and Lesbian Sport Federation, EGLSF sponsors’ rights regarding branding potential, logo rights, exclusive presence, etc. at venues where events are being staged. If at any time during the event, officials designated by EGH determine, at their sole discretion, that my actions may result in the devaluation of said sponsor rights or competes with the event sponsors, I will be required to immediately cease such action, including the removal of any uniforms, signs or other items that compete with sponsor or potentially devalues such sponsorship.

Promotional material

I hereby grant EGH the unconditional right to use at its discretion photographic pictures of myself in any form of media, art, advertising, trade, visual documentary, promotional material, merchandise or film coverage of any kind without compensation to me or approval by me. I will not make any unauthorised reproductions or copies of the EuroGames Helsinki 2016’s logo or likenesses without written permission of EGH.

Applicable law

Any dispute arising out of or in connection with EuroGames Helsinki 2016 including any disputes regarding the existence, validity or termination thereof, shall be settled in accordance with Finnish law in a court of competent jurisdiction in the city of Helsinki, Finland.
